New Forest District Council has been advised that a legal challenge to the Government's controversial boundary changes in Hampshire would have no real chance of success.
Independent legal advice presented to councillors concludes there is ‘not any real prospect of persuading a court that a material error of law has been made, and that a challenge would have no real prospects of success’ – meaning a judge would be unlikely to grant a judicial review.
The ruling relates to the Government's decision to split New Forest and Test Valley parishes into a new South West Hampshire unitary authority, a plan criticised by local politicians, businesses and residents.
New Forest DC cabinet members will consider the legal advice at a meeting on 3 June, after which the council intends to publish it in full.
